Membership Policies

Membership Eligibility

Use of the Sanskriti Website is available only to persons who can enter into a legally binding contract under Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use the Sanskriti Website. If You are a minor i.e. under the age of 18 years, you shall not register as a member of the Sanskriti and shall not transact or use Sanskriti website. As a minor if You wish to use or transact on Sanskriti, such use or transaction may be made by your legal guardian or parents who have registered as users of the Sanskriti. Sanskriti reserves the right to terminate your membership and refuse to provide You with access to the Sanskriti if it is brought to Sanskriti’s notice or if it is discovered that you are under the age of 18 years or are incompetent to contract as per applicable laws

Account and Registration Obligations

If You use Sanskriti, You shall be responsible for maintaining the confidentiality of your User ID and Password and You shall be responsible for all activities that occur under your User ID and Password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or Sanskriti has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the this Terms of Use, Sanskriti has the right to indefinitely suspend or terminate or block access of your membership with Sanskriti and refuse to provide You with access to the Website.

Communications

When You use the Website or send emails or other data, information or communication to Sanskriti, You agree and understand that You are communicating with Sanskriti through electronic records and You consent to receive communications via electronic records from Sanskriti periodically and as and when required. Sanskriti may communicate with You by email or by such other mode of communication, electronic or otherwise.

Charges

Membership on the Sanskriti is free. Sanskriti does not charge any fee for browsing and transacting on Sanskriti. However, Sanskriti reserves the right to charge fee and change its policies from time to time. In particular, Sanskriti may at its sole discretion introduce new services and modify some or all of the existing services offered on the Sanskriti. In such an event Sanskriti reserves, without notice to You, the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the Fee and related policies shall automatically become effective immediately once implemented on Sanskriti. Unless otherwise stated, all fees shall be quoted in Indian Rupees. You shall be solely responsible for compliance of all applicable laws including those in India for making payments to Sanskriti.

Use of Website

You agree, undertake and confirm that your use of Sanskriti shall be strictly governed by the following binding principles:

You shall not host, display, upload, modify, publish, transmit, update or share any information that:

(a) belongs to another person and to which You do not have any right to; or

(g) promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous; or

(h) infringes upon or violates any third party’s rights, (including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person’s name, email address, physical address or phone number) or rights of publicity]; or

(i) promotes an illegal or unauthorized copy of another person’s copyrighted work (see “Copyright complaint” below for instructions on how to lodge a complaint about uploaded copyrighted material), such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files; or

(j) contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page); or
(l) provides material that exploits people in a sexual, violent or otherwise inappropriate manner or solicits personal information from anyone; or

(m) provides instructional information about illegal activities such as making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses; or

(n) contains video, photographs, or images of another person without his or her express written consent and permission or the permission or the consent of his her guardian in the case of minor; or

(o) tries to gain unauthorized access or exceeds the scope of authorized access (as defined herein and in other applicable Codes of Conduct or End User Access and License Agreements) to the Sites or to profiles, blogs, communities, account information, bulletins, friend request, or other areas of the Sites or solicits passwords or personal identifying information for commercial or unlawful purposes from other users; or

(s) refers to any website or URL that, in the sole discretion of Sanskriti, contains material that is inappropriate for the Sanskriti Website or any other Website, contains content that would be prohibited or violates the letter or spirit of these Terms of Use; or

(t) harm minors in any way; or

(u) infringes any patent, trademark, copyright or other proprietary rights or third party’s trade secrets or rights of publicity or privacy or shall not be fraudulent or involve the sale of counterfeit or stolen items; or

(v) violates any law for the time being in force; or

(w) deceives or misleads the addressee/ users about the origin of such messages or communicates any information which is grossly offensive or menacing in nature; or

(x) impersonate another person; or
(y) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; or contains any Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptitiously intercept or expropriate any system, data or personal identifiable information; or

(z) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting to any other nation; or

(aa) shall not be false, inaccurate or misleading; or

(ab) shall not, directly or indirectly, offer, attempt to offer, trade or attempt to trade in any item, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation or guideline for the time being in force; or

(ac) shall not create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers.

You shall not use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Website or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Website or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Website. Sanskriti reserves the right to bar any such activity.

I. It is possible that other users (including unauthorized users or “hackers”) may post or transmit offensive or obscene materials on Sanskriti and that You may be involuntarily exposed to such offensive and obscene materials. Payment

(1) While availing any of the payment method/s offered at Sanskriti, www.indiawellnesstours.com will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to You due to:

I. Lack of authorization for any transaction/s; or 
II. Exceeding the preset limit mutually agreed by You and between your “Bank/s”; or 
III. Any payment issues arising out of the transaction, or 
IV. Decline of transaction for any other reason/s. 

(2) All payments made against the purchases/services on Sanskriti by You shall be compulsorily in Indian Rupees acceptable by the Union of India. Sanskriti does not accept any other form of currency with respect to the purchases made on Sanskriti.

Breach

Without limiting other remedies, indiawellnesstours.com may limit your activity, immediately remove your information, warn other Users of your actions, immediately temporarily/indefinitely suspend or terminate or block your membership, and/or refuse to provide You with access to the indiawellnesstours.com website in the event, but not limited to:

I. If You breach the Terms of Use or Privacy Policy or other rules and policies, if any;

III. Applicable Law

This Agreement shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in Bangalore.

Pricing/Typographical Error

If indiawellnesstours.com comes across any difference in pricing resulting from typographic errors wrt pricing or product information, indiawellnesstours.com shall have the right to rectify the same or cancel the order(s) and refund monies, if any, collected from the customer within 10-15 business days of such corrective action taken. Cancellation of order

indiawellnesstours.com reserves the right to cancel any order without any explanation for doing so, under situation where indiawellnesstours.com is not able to meet the requirement of the order placed or order so placed/cancelled does not comply with the indiawellnesstours.com policy or order has invalid address/incorrect information or for any other reason. However, indiawellnesstours.com will ensure that any communication of cancellation of an order, so cancelled, is intimated within appropriate time to the concerned person and any applicable refund, will be made in reasonable time.

1. Sale/discounts apply to selected items only. Although there are many brands on SALE, there might be some exclusion.
2. The End of Season Sale runs till stock lasts. Sale up to 50% off does not imply that all products are on discount.
3. No two offers can be clubbed together. The “Buy worth Rs.2500 or more and get 20% off on your purchase amount” Promotion will not be valid on a purchase of products that already have an exclusive offer. 
4. Due to technical issues, typographical errors or information received from our suppliers and service providers, prices of the products shown on the Site may vary during the order process. If you come across any errors in pricing or billing, we request you to contact us within 24 hours of receiving your order so that we may provide a remedy for the same.
5. All offers are non-transferable and have no cash value.
6. indiawellnesstours.com reserves the right to extend/ terminate/amend/add/remove/modify (in whole or part) the offers/sale, without further information at any point of time and indiawellnesstours.com’s decision in this regard shall be final and requires no intimation to the customer of any sort.

Refund and Returns Policy

Overview

Our refund and returns policy lasts 30 days. If 30 days have passed since your purchase, we can’t offer you a full refund or exchange.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

Several types of goods are exempt from being returned. Perishable goods such as food, flowers, newspapers or magazines cannot be returned. We also do not accept products that are intimate or sanitary goods, hazardous materials, or flammable liquids or gases.

• Downloadable software products
• Some health and personal care items

To complete your return, we require a receipt or proof of purchase.

Please do not send your purchase back to the manufacturer.

There are certain situations where only partial refunds are granted:

• Book with obvious signs of use
• CD, DVD, VHS tape, software, video game, cassette tape, or vinyl record that has been opened.
• Any item not in its original condition, is damaged or missing parts for reasons not due to our error.
• Any item that is returned more than 30 days after delivery

Refunds

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Late or missing refunds

If you haven’t received a refund yet, first check your bank account again.

Then contact your credit card company, it may take some time before your refund is officially posted.

Next contact your bank. There is often some processing time before a refund is posted.

Sale items

Only regular priced items may be refunded. Sale items cannot be refunded.

Exchanges

We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at {email address} and send your item to: {physical address}.

Gifts

If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and they will find out about your return.

Shipping returns

To return your product, you should mail your product to: {physical address}.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you may vary.

If you are returning more expensive items, you may consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.
